What is Being Asked of Employers?

On September 30, 2023, California Senate Bill 553 (Cortese) was signed into law, and California Labor Code section 6401.9 will take effect on July 1, 2024. Employers covered by this law must establish, implement, and maintain a comprehensive written Workplace Violence Prevention Plan. This plan must include, but is not limited to, the following components:

  • Identifying the individuals responsible for implementing the plan

  • Involving employees and their representatives in the process

  • Accepting and responding to reports of workplace violence, while prohibiting employee retaliation

  • Communicating with employees about workplace violence issues

  • Responding to actual and potential emergencies

  • Developing and providing effective training programs

  • Identifying, evaluating, and mitigating workplace violence hazards

  • Conducting post-incident response and investigations

      • Maintenance of workplace violence incident report logs.

We provide both resources and training to meet all legislative requirements. Our curriculums incorporate adult learning concepts, allowing attendees to discuss concerns and provide insights during the courses. The content and vocabulary of our curriculums are tailored to the education level, literacy, and language of employees, as required by the labor code.

Our curriculums and framework are guided by California Labor Code sections 6401.7 and 6401.9, resulting from Senate Bill 553 (Cortese). As prescribed by California Labor Code section 6401.9, our offerings address:

  • Defining key workplace violence prevention terms.

  • Educating on the development of a workplace violence prevention plan involving employees.

  • Providing templates and education on maintaining a workplace violence incident log, recording various details about each incident.

  • Training employees on workplace violence prevention, with materials suitable for their education level and language.

  • Ensuring proper record-keeping of workplace violence hazard identification, evaluation, correction, training, incident logs, and investigations, to be available to state authorities and their representatives.

Our approach ensures compliance with the requirements of California Labor Code 6401.9, which will become operative on July 1, 2024.
